Leving firm saves dad from order of protection that kept him from daughter

Chicago, Sep 18, 2020 (Issuewire.com) - CHICAGO - Fathers' Rights attorney Jeffery M. Leving has spoken often about orders of protection based on flimsy or non-existent evidence that keep fathers separated from their children.

This week on the Dads Rights Legal Hour, Leving, the founder and president of the Law Offices of Jeffery M. Leving Ltd. in Chicago, will talk about a father who was in such a situation, and how the Leving legal team got him out of it. The program airs 9-10 a.m. CDT Saturday, Sept. 19, on Power 92.3 FM in Chicago.

This father was under an order of protection that kept him apart from his daughter -- an order that was entered before the man was represented by the Leving firm. Once Leving and his team were retained, they discovered the facts and asserted to the judge that much of the evidence on which the order was based was either exaggerated or completely made up - and they had the evidence to prove it.

"I think some people going through a divorce try to gin up an order of protection to gain leverage in their divorce - and I suspect that's happening here, so it was extra important that we end this order. And we did! The judge granted our request not to extend the order of protection," Leving says.

Leving characterizes this as an important court victory, modified for broadcast, which will benefit this devoted father and his daughter. "I'm really glad he called me, and that we could get him the result in court that he needed and deserved," he says.

Leving also will talk about the police, and instances where they use force, sometimes deadly force. "Anytime the police have to be called, there's a problem, and this is especially so in the area of law that I practice, when we're dealing with domestic violence, orders of protection, possible violations of orders of protection, disputes over turning over children to the other parent, and DCFS abuse investigations. These are high-stress, high-emotion situations, and I keep my fingers crossed and say my prayers every time the police show up that somebody is not shot," Leving says.

He mentions that Jacob Blake, the father of three who was shot in the back by police in Kenosha, Wisconsin while he was getting into his car, with his kids already in the car, took a phone call from vice presidential candidate Sen. Kamala Harris when she visited Kenosha. Blake is still in the hospital, paralyzed. Blake told Harris that he's proud of her, and she said she's proud of him for the way he's working through his pain. Blake assured the senator that he was not going to give up on life, for the sake of his children.

"This man is hanging on to life for his kids, and I think we can learn a valuable lesson from him in terms of fathers knowing they have a responsibility for their children," Leving says.

He urges listeners to stay calm around the police. "I realize everyone is under a lot of stress," Leving says. "Especially when the police turn up at a home for a domestic dispute, they never know what they're going to find on the other side of that door. I suggest to anyone who's involved in a domestic situation where the police are called, be as calm as possible around the police. Don't be a target looking for an arrow!"
