Walnut Creek, California – A jury in Orange County Superior Court returned a verdict of $26.3 million in favor of a man who suffered catastrophic spinal cord injuries with paralysis following a rollover accident involving a Yamaha off-road vehicle.
Larry Cook of Casper, Meadows, Schwartz & Cook, working as co-counsel with Walkup, Melodia, Kelly & Schoenberger, represented Justin Van Tussenbrook after he was paralyzed when the Yamaha YXZ1000R’s rollover protection system collapsed. After several hard-fought years of litigation, a jury found the vehicle to be defectively designed and Yamaha negligent for failing to recall or retrofit the model despite evidence of known rollover safety issues.
This is the second client represented by Casper, Meadows, Schwartz & Cook who was paralyzed by the same model due to failure of its rollover protection, the first concluding with a confidential settlement.
The verdict stands as a powerful affirmation that when manufacturers place dangerous products into the stream of commerce and continue to promote them as safe, the consequences can be catastrophic – and accountability matters.
