RealTruck claims Rough Country has once again infringed on patents related to truck bed covers; Move reinforces unwavering commitment to protect its innovations
RealTruck, a global aftermarket product and accessory brand and a digital destination for truck, Jeep®, Bronco® and off-road enthusiasts, has filed another patent infringement lawsuit on behalf of its TruXedo product line against Rough Country, LLC, in the U.S. District Court for the Western District of Tennessee. The lawsuit identifies multiple acts of patent infringement committed by Rough Country related to the sale of its hard roll-up truck bed covers.
RealTruck, under its TruXedo product line, is a global leader in the development, manufacturing, and sale of truck bed covers and holds more than 1,000 issued and pending patents, including numerous patents for the products covered by the lawsuit. The lawsuit claims Rough Country is manufacturing, selling, and importing into the United States a hard roll-up truck bed cover that infringes on RealTruck’s intellectual property.

This latest action represents yet another lawsuit in a long list of claims by RealTruck against Rough County for blatant intellectual property infringement in the truck bed cover and step categories. Most recently, RealTruck’s UnderCover and BAK product lines achieved a significant victory in the critical Markman phase of its lawsuit against Rough Country relating to certain hard folding truck bed covers. In 2022, another dispute between the two companies was pending before the U.S. International Trade Commission and, to RealTruck’s great satisfaction, resulted in Rough Country agreeing to cease all U.S. sales of the automated retractable vehicle steps in question.
“Policing and defending our intellectual property and our more than 1,000 patents and patent applications is a top priority at RealTruck,” said Eric Dale, Chief Legal Officer and Executive Vice President, RealTruck. “It’s clear that Rough Country’s truck bed cover and steps business model, which appears to be premised on violating others’ IP and reliant on generating revenue during the pendency of lengthy court proceedings, is neither sustainable nor consistent with responsible business ethics. In my decades of experience, I can’t recall as decisive a victory as that which we recently achieved against Rough Country in the hard folding cover case, so I was surprised that they are continuing down the same path in the hard roll-up cover category. Given our past successes against this defendant, we are highly confident that this lawsuit will resolve in favor of RealTruck.”
The lawsuit was filed last month in the United States District Court for the Western District of Tennessee – Eastern Division.
