The firm filed a lawsuit in South Carolina in December 2018 against Toyota Motor Corporation on behalf of lead plaintiff Gary Weinreich. The lawsuit alleges that the frames on 2003-2009 Toyota 4Runners rust prematurely due to improper treatment against rust corrosion during manufacturing. According to the lawsuit, the defect causes severe premature rusting of the undercarriages on the 4Runners and poses a dangerous risk. The claim states that “the excessive rust corrosion on the Toyota 4Runner compromises the vehicles’ safety, stability, and crash-worthiness because important suspension components, engine mounts, transmission mounts, and body mounts anchor to the vehicles’ frames.” Documentation also shows that Toyota was aware of the problem and did not warn consumers or offer a solution to the issue.

Lead plaintiff Weinreich bought a new Toyota 4Runner in 2005 and noticed excessive rusting in 2011. In 2018, the front steering control arm of his 4Runner broke off, causing him to run off the road. The case claims that Weinreich attempted to contact Toyota during this time to voice his concerns over the excessive rusting, and Weinreich states that Toyota ignored his concerns.

Another class-action lawsuit involving Toyota Tacomas (2005-2010), Sequoias (2005-2008) and Tundras (2007-2008) experiencing the same premature rusting issues was settled in 2020. The settlement was for about $3.4 billion in benefits to the class.
