On October 11, 2017, Ark Rustic Inn (d/b/a Rustic Inn Crabhouse), a wholly-owned subsidiary of Ark Restaurants Corp. (collectively, the “Company”) entered into a Settlement Agreement with the U.S. Department of Justice, Civil Rights Division, Immigration and Employee Rights Section (“IER”). IER had charged that the Company had terminated an employee after he failed to present immigration status documentation in violation of unfair immigration-related employment practices. IER concluded that the Company engaged in a pattern or practice of unfair documentary practices based on citizenship status; however, IER lacked reasonable cause to believe the Company unlawfully terminated the former employee.
The Company was fined a civil penalty of $4,000
and has been required to take various corrective employment practices.
