Item 8.01. Other Events
On June 8, 2015, Southwestern Public Service Company (SPS), a New Mexico corporation, and a wholly owned subsidiary of Xcel Energy Inc., filed an electric rate case with the New Mexico Public Regulation Commission (NMPRC) for an increase in base rates for a net amount of $1.4 million for the New Mexico retail jurisdiction. The proposal reflected an increase in non-fuel base rates of $31.5 million and a base fuel decrease of $30.1 million. The rate filing was based on a forecasted test year (FTY) ending Dec. 31, 2016, a requested return on equity of 10.25 percent, a jurisdictional electric rate base of $777.9 million and an equity ratio of 53.97 percent. SPS had expected an NMPRC decision and implementation of final rates in summer 2016.
On June 24, 2015, SPS’ rate case application was verbally dismissed by the NMPRC at its open meeting. The NMPRC determined that the filing did not comply with their new interpretation of the statute regarding FTY periods and the corresponding timing of a rate case submission. This interpretation occurred during the recent Public Service Company of New Mexico rate case. A final written order to dismiss SPS’ rate filing is pending.
SPS plans to refile the rate case later this year and will consider its other options after reviewing the written order.
