ITEM 8.01 Other Events
On July 21, 2010, the DoddFrank Wall Street Reform and Consumer Protection Act (the Act) was enacted. Section 1503 of the Act included new reporting requirements related to mine safety, including disclosing on a Current Report on Form 8-K the receipt of an imminent danger order under Section 107 (a) of the Federal Mine Safety and Health Act of 1977 (the Mine Act) issued by the Federal Mine Safety and Health Administration (MSHA).
On Tuesday, May 10, 2011, Warrior Coal, LLC (Warrior), an operating subsidiary of the Partnership, was issued an imminent danger order under Section 107(a) of the Mine Act. The order was issued after an MSHA coal mine inspector alleged that a portion of the mine wall, or rib, was loose near the general vicinity of a roof bolting machine of the mines #2 Unit. Warrior disputes the MSHA inspectors findings, including his description of the coal rib as loose and his allegation that the rib constituted an imminent danger. Warrior intends to seek judicial review of the orders issuance.
