ITEM 1.04 MINE SAFETY REPORTING OF SHUTDOWNS AND PATTERNS OF VIOLATIONS
On July 21, 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act (the Act) was enacted. Section 1503 of the Act included new reporting requirements related to mine safety, including disclosing on a Current Report on Form 8-K the receipt of an imminent danger order under Section 107(a) of the Federal Mine Safety and Health Act of 1977 (the Mine Act) issued by the federal Mine Safety and Health Administration (MSHA).
On Thursday, November 5, 2015, at approximately 3:32 p.m., Central Time, Sebree Mining, LLC (Sebree), an operating subsidiary of Alliance Resource Partners, L.P., received an imminent danger order under Section 107(a) of the Mine Act at the Onton #9 Mine. The Order was issued when a representative of MSHA alleged the existence of excessive methane within a discrete area located near a set of 120 psi seals. The seals are used to separate older, previously mined areas from areas actively being mined for coal. No miners were injured as a result of any of the conditions alleged in the Order. Sebree adjusted ventilation controls within the area and the Order was terminated. Sebree is reviewing MSHAs Order and may seek judicial review of its issuance.
