(1) | The original Form 4 is being amended to correct errors in the reported amounts of Mr. Hartley's holdings. This amendment reduces Mr. Hartley's direct holdings by 139,419 shares. These shares were distributed from the National Information Consortium Voting Trust ("Voting Trust") to trusts for the benefit of Mr. Hartley's children on October 29, 2003 and January 28, 2005 and were inadvertently shown as directly beneficially owned by Mr. Hartley. 92,946 of such shares are now shown as indirectly owned by Mr. Hartley and the remaining 46,473 shares were previously distributed from a trust for the benefit of his daughter to his daughter in a gift transaction and are no longer shown as beneficially owned by Mr Hartley. The number of shares held indirectly through the Voting Trust has been increased by 6 shares to 5,452,077 shares to correct an error in the calculation of the number of shares held through the Voting Trust. |

(3) | The Reporting Person and Jeffery S. Fraser are co-trustees of the Voting Trust, which holds 21,400,805 shares of NIC Inc. common stock, and as co-trustees they share voting and investment power with respect to the shares held by the Voting Trust. The Reporting Person disclaims beneficial ownership of the shares held of record by the Voting Trust, except to the extent of his pecuniary interest noted herein. The Reporting Person and two of his children have in the aggregate of 25.5% pecuniary interest in the Voting Trust, represented by 4,952,773 shares held of record by the Voting Trust for the benefit of the Reporting Person, and 499,304 shares held of record by the Voting Trust for the benefit of the Reporting Person's children. |
